General Terms of Service


Idweb Ltd provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Idweb Ltd are subject to the following terms of service:


Indemnification Policy

You agree to use all Idweb Ltd services and facilities at your own risk. Idweb Ltd specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Idweb Ltd be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Idweb Ltd harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Idweb Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Idweb Ltd against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Idweb Ltd's server.

Idweb Ltd reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Idweb Ltd's server. Idweb Ltd shall be the sole judge of what violates this Policy.


Billing:

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee is nonrefundable).


Template orders can only be cancelled and refunded if the work has not been carried out, once the website has been installed, this service is non-refundable.


We accept Visa, Master Card, American Express, Discover Card. For webhosting plans we will setup your account without any paying. Clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.


Late Payments:

All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. Late payment of invoices incurres a 10% late payment fee. You will receive an email reminder 5 days till deactivation.


Acceptable Use Policy:

All services provided by Idweb Ltd may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Idweb Ltd and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all Idweb Ltd servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.


Complaints and appeal procedures:

We are committed to ensuring our customers receive a high standard of service. We also appreciate that, with a large customer base, sometimes issues arise that need to be addressed. Your comments are important to us. We rely on feedback from our customers to identify the root causes of complaints. This allows us to put things right for you and ensure improvements are made. We aim to do this quickly and efficiently.

Stage 1: Contacting us

If you have a complaint about any aspect of our service, then we would like to hear from you. Many outstanding issues can be resolved informally by discussing the issue with a member of staff. The support agent who deals with your query will aim to resolve any outstanding issues and reach an amicable resolution.

Stage 2: Escalating your issue

If the agent helping you is not able to assist please ask to speak to a manager. If a manager is available they will be happy to talk to you to discuss your case. Managers are available on main working days during business core hours. Managers do however attend meetings and may not be available at that time. If a manager is not available, please provide your contact details to a member of staff and our management team will be in touch. Our aim is to respond to all escalated complaints within 1 hour.

Raising an Appeal

If after discussing any concerns you are dissatisfied with the response provided, or the way your issue has been dealt with, you can lodge an appeal by writing to the below address, detailing your account details and the outstanding complaint.

Your complaint will be acknowledged in writing or via telephone within three working days of receiving the complaint. An investigation will be carried out into the issues raised and a full response will be provided within ten working days.

Where the issue is particularly complex it may take longer to respond. If this is likely, we will provide information on the action which will be taken and advise when you can expect a full response.


LIMITATION OF LIABILITY:

Idweb Ltd shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Idweb Ltd servers going off-line or being unavailable for any reason whatsoever. Furthermore, Idweb Ltd shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Idweb Ltd servers. All damages shall be limited to the immediate termination of service.


DISCLAIMER:

Idweb Ltd cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Idweb Ltd are resold. Thus, certain equipment, routing, software, and programming used by Idweb Ltd are not directly owned or written by Idweb Ltd. Moreover, Idweb Ltd holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Idweb Ltd sees fit. FURTHERMORE, Idweb Ltd retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

Idweb Ltd Domain Name Terms and Conditions

1. These terms apply to all new and existing Clients of Idweb Ltd seeking to register a name.

2. Registration of domain names operates on a first come first served basis. For the avoidance of all doubt, Idweb Ltd may only offer registration of domains in the following situations:

a) Where individual Clients are at least 18 years of age;
b) Where the Client is a UK resident. For non-UK residents a proxy will be automatically provided to enable registration. Clients acknowledge and understand that PO Boxes will be unacceptable as an address;

3. Idweb Ltd does not take responsibility for any unsuccessful applications based on incorrect information entered by Clients.

4. Domain names will be charged at the price advertised on the Idweb Ltd website or the email communication provided to existing Clients who have registered domain names. These prices exclude VAT.

5. Domain names are charged at £9.95 for a .uk and £12.99 for a .net or .com (plus VAT) per year of registration and may be registered for multiple years but no more than 10 (ten) years.

6. Clients acknowledge that whilst Idweb Ltd will use its reasonable endeavours to register a domain, Idweb Ltd does not accept any liability if the Registry (for whatsoever reason) is incapable of registering the domain name.

7. Idweb Ltd does not accept liability for the unsuccessful registration of a domain name which is caused by unforeseen circumstances.

8. Payment for the relevant domain the Client has registered will be taken at the time of placing the order.

9. Clients acknowledge that transfer of a domain names are chargeable at the rate of £9.99 (plus VAT) per domain name.

10. Clients understand and accept that they are responsible for ensuring prior to payment that the items in their basket are the items they wish to purchase. Clients have the opportunity to remove any unwanted items or add further items before payment is taken.

11. Registration of domain names is subject to Idweb Ltd General Terms and Conditions and Idweb Ltd Domain Registration, Renewal and Refund Agreement. If there is any conflict between these Registration terms and the Idweb Ltd General terms, then the terms set out herein shall prevail.

12. Idweb Ltd reserves the right to end this service, extend this service and or amend the terms and conditions of this service at any time without the prior notice or consent of the Client. Reasonable usage applies.



Abuse Policy


We work to minimise the amount of abuse that is generated on our servers. You can help us by reporting any abuse you spot which you believe has come from the Idweb Ltd network.

Please report all abuse by emailing us at support@xtrader.co.uk. Please include as much information as you can about the type of abuse you've encountered. Please also provide log files (if applicable), URLs for site abuse and email headers for spamming.

Once we've received your email, we'll investigate the issue thoroughly, contact any relevant customers and work to resolve the issue as quickly as possible.
